1. Acceptance of Terms
These Terms of Service govern your access to and use of diamondccs.org and related webpages, forms, and online features operated by Diamond Creative Collective (“DCC,” “we,” “us,” or “our”).
By accessing or using the website, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the website.
These Terms govern use of the website. They do not replace any separate written agreement governing professional services provided by DCC.
2. Website Purpose
The website provides information about Diamond Creative Collective, our services, industries we serve, creative approach, and ways to contact or inquire about working with us.
Website content is provided for general informational and promotional purposes. Viewing the website or submitting an inquiry does not create a client relationship or require DCC to accept an engagement.
3. Services and Client Agreements
Diamond Creative Collective provides creative content and visual marketing services that may include:
- Ongoing content creation
- Project and commercial photography
- Website and brand imagery
- Short-form and vertical video
- Reels and social media content
- Content planning and organized content libraries
- Campaign and dedicated content days
- Selected social media and marketing support
The scope of each engagement may vary depending on the client, project, package, production requirements, and ongoing relationship.
Professional services are governed by the proposal, service agreement, statement of work, invoice terms, licensing terms, or other written agreement applicable to the engagement (“Client Agreement”).
Client Agreements may contain specific terms regarding deliverables, shoot dates, payment schedules, retainers, cancellations, rescheduling, revisions, turnaround times, licensing, usage rights, confidentiality, travel, and additional work.
If these website Terms conflict with an executed Client Agreement regarding professional services, the Client Agreement controls for that engagement.
4. Inquiries, Consultations, and Availability
Submitting a contact form, consultation request, email, or other inquiry does not guarantee acceptance of a project or reservation of a date.
A consultation is intended to discuss your business, content needs, possible scope, and whether DCC may be a good fit. A consultation alone does not create a binding services agreement.
Dates are considered confirmed only when the applicable booking requirements in the Client Agreement, proposal, or booking documentation have been completed.
5. Pricing and Payments
Prices, starting prices, packages, and service descriptions displayed on the website are informational and may change.
Final pricing may depend on project scope, frequency, production requirements, location, travel, licensing, deliverables, personnel, and other project-specific factors.
The price and payment terms for a specific engagement will be stated in the applicable Client Agreement, proposal, invoice, or booking documentation.
Retainers, deposits, installment schedules, cancellation fees, rescheduling fees, late fees, and refund policies are governed by the terms applicable to the individual engagement.
6. Intellectual Property
Unless otherwise stated, the website and its original design, copy, branding, graphics, logos, photographs, videos, and other creative materials are owned by, licensed to, or used with permission by Diamond Creative Collective.
You may view website content for personal or internal business evaluation purposes. Without prior written permission, you may not reproduce, republish, sell, license, distribute, or commercially exploit DCC website content.
Ownership, commercial licenses, advertising rights, website rights, social media rights, and other usage rights for client deliverables are governed by the applicable Client Agreement.
Nothing on this website independently transfers copyright or grants a license to use DCC-created content.
7. Client-Provided Materials
If you provide DCC with logos, photographs, video, music, copy, trademarks, documents, products, or other materials for use in a project, you are responsible for having the rights and permissions necessary for the requested use.
You agree not to knowingly provide material that infringes another party's copyright, trademark, privacy, publicity, contractual, or other rights.
8. Portfolio, Publicity, and Confidentiality
DCC may display completed work in our website, portfolio, social media, proposals, presentations, case studies, or promotional materials when permitted by the applicable Client Agreement or otherwise authorized by the client.
We recognize that some clients, projects, properties, and engagements require confidentiality. Written confidentiality, nondisclosure, embargo, or portfolio restrictions will be governed by the applicable Client Agreement or nondisclosure agreement.
These website Terms do not independently authorize DCC to publish confidential client information.
9. Acceptable Use
You agree not to use the website to:
- Gain unauthorized access to systems or accounts
- Interfere with website security or functionality
- Introduce malware or harmful code
- Submit fraudulent or unlawful information
- Abuse contact forms or website resources
- Violate DCC's intellectual property rights
- Violate another person's rights
- Engage in unlawful activity
10. Third-Party Services and Links
The website may link to or integrate with third-party services, including scheduling platforms, social media services, email providers, analytics providers, hosting providers, and payment processors.
Third-party services are governed by their own terms and privacy policies. DCC is not responsible for the independent content, practices, security, or availability of third-party services.
11. No Guarantee of Marketing or Business Results
DCC provides creative services intended to support a client's marketing, brand presence, and content needs.
Unless expressly guaranteed in a signed Client Agreement, DCC does not guarantee any particular number of leads, inquiries, bookings, sales, followers, views, engagement, website traffic, search rankings, revenue, return on investment, or other business outcome.
Testimonials, portfolio examples, or prior client experiences do not guarantee identical outcomes for another business.
12. Website Disclaimers
We make reasonable efforts to maintain accurate and current website information, but we do not guarantee that every service description, price, availability statement, link, or other item will always be complete, current, or error-free.
To the fullest extent permitted by applicable law, the website is provided on an “as is” and “as available” basis.
Nothing on the website constitutes legal, financial, accounting, tax, or other regulated professional advice.
13. Limitation of Liability
To the fullest extent permitted by applicable law, Diamond Creative Collective and its owners, employees, contractors, and representatives will not be liable for indirect, incidental, special, punitive, or consequential damages arising from use of, inability to use, or reliance on the website.
Liability arising from professional services provided to a client is governed by the applicable Client Agreement rather than this website provision.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
14. Privacy
Your use of the website is also subject to our Privacy Policy, which explains how DCC collects, uses, and handles information collected through the website.
15. Changes to These Terms
We may update these Terms from time to time to reflect changes to the website, our business practices, or applicable requirements.
When updated, the “Last updated” date at the top of this page will be revised.
16. Governing Law
These Terms and disputes concerning use of the website are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except where applicable law requires otherwise.
Governing-law, venue, mediation, arbitration, or other dispute provisions for professional services may be separately established in the applicable Client Agreement.
17. Severability and Waiver
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.
DCC's failure to enforce any provision does not constitute a waiver of that provision or any other right.
